General Terms and Conditions for Purchases in the Online Shop at notyourbabe.de

§ 1 General Provisions, Scope of Application

1.1 All deliveries and services are exclusively subject to the following General Terms and Conditions (hereinafter “GTC”) in the version valid at the time of the order.

1.2 The contracting party is Royce Digital Services GmbH, Münchenerstraße 67, 83395 Freilassing, Germany, Managing Director: Julia Gruber (hereinafter “Seller”).

1.3 Customers as defined by these terms and conditions can be consumers (hereinafter “Customer”). Consumers are natural persons who conclude a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of Contract

2.1 Our offer is binding. By placing your order, you accept our offer to conclude a contract. The contract is concluded once you send us your order. You will receive an order confirmation via email.

2.1 Product displays do not constitute binding offers. Your order constitutes a binding offer pursuant to § 145 of the German Civil Code (BGB), which we may accept. After your order is sent, you will first receive an order receipt confirmation by email. If we accept your order, you will receive an order confirmation via email within 3 working days, which constitutes the conclusion of the contract.

2.2 If you find a desired product, you can click on the product name or image to view details. By clicking the button [Add to Cart], the item is placed in your cart. You can view and edit the contents of the cart at any time via [Cart]. To purchase the items, go to [Checkout].

During checkout, you will create a customer account (if it’s your first purchase), and select the shipping and payment method. In the final step under “Order Information”, you will see a summary of your order and can edit your details. Errors can be corrected by navigating back in your browser or restarting the process. To complete the purchase, you must accept the GTC and click [Buy].

§ 3 Storage of Contract Text

We store your order, the entered order data, and the full contract text. You will receive an order confirmation email with all details and the contract text.

§ 4 Right of Withdrawal for Consumers

The following right of withdrawal applies only to consumers in distance selling:

  1. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you (not the carrier) took possession of the goods.

To exercise your right of withdrawal, you must inform us (name, address, telephone number, fax, and email if available) via an unambiguous statement (e.g., postal letter or email). You may use the attached sample withdrawal form, but it is not mandatory.

It is sufficient to send your notification before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except additional costs for a more expensive delivery option), promptly and at the latest within fourteen days from the day we receive your withdrawal notice. We will use the same payment method you used for the original transaction unless otherwise agreed; no fees will be charged for the refund. We may withhold the refund until we have received the goods back or you have provided proof of return.

You must return the goods without delay and in any case no later than fourteen days from the day you notify us of the withdrawal. The deadline is met if you dispatch the goods before the end of the 14-day period. You bear the direct costs of the return.

You are only liable for any loss in value if this results from handling the goods beyond what is necessary to assess their condition, characteristics, and functionality.

  1. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made goods tailored to the customer’s needs;

  • Perishable goods or items with a short expiration date;

  • Sealed goods not suitable for return due to hygiene/health if unsealed after delivery;

  • Goods inseparably mixed with others after delivery;

  • Sealed audio/video recordings or software unsealed after delivery;

  • Newspapers, magazines, or periodicals, except subscriptions;

  • Services in accommodation (other than for residential purposes), transport, car rental, food/drink delivery, or leisure events if the contract includes a specific date or time.

§ 6 Prices and Shipping Costs

All prices include statutory VAT and exclude shipping costs. We ship via DHL, UPS, or another provider of our choice.

§ 7 Delivery Conditions

7.1 We deliver only within the EU and Norway.

§ 8 Payment Terms

8.1 Payment may be made in advance by bank transfer, credit card (VISA, Mastercard), immediate transfer, direct debit, or invoice. We reserve the right to exclude certain payment methods.

8.2 We retain ownership of the goods until full payment is received.

8.3 In case of payment default, we charge interest at 5 percentage points above the base rate.

§ 9 Warranty

If you are a consumer, warranty is provided in accordance with statutory provisions.

§ 10 Liability

We are fully liable for intent and gross negligence and under the Product Liability Act. For slight negligence, we are only liable for injury to life, body, or health.

Otherwise, liability for slight negligence only applies to breaches of essential contractual obligations (cardinal duties). In such cases, liability is limited to typical foreseeable damages. This also applies to our agents and legal representatives.

§ 12 Miscellaneous

12.1 The contract language is German.

12.2 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obligated or willing to participate in dispute resolution before a consumer arbitration board.

12.3 If any provision of these GTC is invalid, the remainder of the contract remains effective. Invalid provisions shall be replaced by the applicable legal regulations.
